This Legal Notice establishes the conditions of use of the website service, (hereinafter the Website) that the RECOVER FOUNDATION, makes available to Internet users (hereinafter referred to as Users).

This website strictly complies with Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD). It also complies with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons (RGPD), as well as with Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSICE or LSSI).

Services and/or products are only available to legal entities and persons who are 16 years old.

1 - General conditions of use

These General Terms and Conditions regulate access to and use of the web pages comprising the Recover Function website, including the content and services made available therein. Any person accessing the website, www.fundacionrecover.org ("user") agrees to be bound by the General Terms and Conditions in force at any given time on the website. www.fundacionrecover.org .

It is understood that access to and use of the website or the consumption of the services and content it offers implies the assumption of the role of user and, therefore, the unreserved acceptance of each and every one of these conditions of use, which are subject to modification. Consequently, they must be read by the user each time the website is visited.

The use of the same attributes to the navigator the condition of User, which implies adherence to and commitment to comply with each and every one of the conditions contained in this Legal Notice, in the version published at the time of accessing the Website, for which reason the User is recommended to read this Legal Notice carefully each time he/she accesses the same, as these conditions of use contained in this Legal Notice may undergo modifications. Access to and use of the Website is free of charge for Users and does not generally require prior registration for browsing and viewing the content provided on the Website. However, access to and use of certain functionalities offered on the Website requires the provision of certain personal data, by means of the formalisation by the User of the forms provided therein and the prior acceptance of the privacy policy.

Access to this Website is the sole responsibility of the Users and implies acceptance of these terms and conditions of use.

The User undertakes to make lawful use of the Website and its services and functionalities in accordance with these terms and conditions of use and current legislation. FUNDACIÓN RECOVER is not responsible for and does not guarantee that access to the Website will be uninterrupted or error-free. Nor does it accept any liability or guarantee that the content or software that can be accessed via the Website is free from error or will cause damage. Under no circumstances shall FUNDACIÓN RECOVER be liable for any loss, damage or harm of any kind arising from accessing and browsing the Website, including but not limited to those caused to computer systems or those caused by the introduction of viruses.

FUNDACIÓN RECOVER shall not be liable for any damages that may be caused to Users by improper use of the Website. Under no circumstances will FUNDACIÓN RECOVER be liable for the inadequate functioning of the system, if this inadequate functioning is due to a defective configuration of the User's equipment or to its lack of capacity to support the computer systems necessary to make use of the service.

Access to the Website requires services and supplies from third parties, including transport through telecommunications networks, whose quality, continuity and operation does not correspond to FUNDACION RECOVER. FUNDACION RECOVER shall not be liable for damages of any kind caused to the User as a result of failures or disconnections in telecommunications networks that lead to a suspension, cancellation or interruption of the service of the Website during the provision of the same.

The User undertakes to use the contents in accordance with the Law and the present general conditions set out in this Legal Notice. By way of example and without limitation, the User, in accordance with current legislation, will refrain from:

FUNDACIÓN RECOVER makes every effort to avoid any errors in the content that may appear on the website. In any case FUNDACIÓN RECOVER does not guarantee, nor is it responsible for any consequences that may arise from errors in the content that may appear on the Website.

FUNDACION RECOVER may make any modifications it deems appropriate to the Website, and may include services and new content in addition to the current ones or, where appropriate, remove the current ones.

In the event that the Website enables the introduction of comments, FUNDACION RECOVER reserves the right to remove any comments that are contrary to law, and public order, or that violate the respect for the dignity of the person, that are discriminatory, xenophobic, racist, that threaten youth or childhood, order or public safety or that, in his opinion, are not suitable for publication. The information appearing on the Website is current as of the date of its last update. FUNDACIÓN RECOVER reserves the right to modify, update or delete any information contained on the website.

You may not alter, change, modify, or adapt the Website by the User. FUNDACIÓN RECOVER reserves the right to make as many updates, changes and modifications as it deems appropriate, and may make use of this right at any time and without prior notice.

5 - Terms and conditions of donations made to Recover Foundation

The present terms and conditions that appear on this website regulate the donations made in favour of the RECOVER FOUNDATION and can be read on this website. They may be modified upon publication on the website, this being the main method of notification to DONORS. The RECOVER FOUNDATION may, in any case, supplement such communication by another channel, such as sending an email or a letter, among others.

FUNDACIÓN RECOVER is the recipient of the donation and the DONOR is the natural or legal person who makes the contribution. The latter is responsible for the veracity of the data he/she provides when making the donation.

To formalise the donation, the DONOR shall complete all the phases established in the DONATION process and, once formalised, shall conclude with the delivery of the corresponding amounts.

The DONOR will receive a certificate of their donation for tax purposes.

Through this website, the DONOR can make the following types of donations to the RECOVER FOUNDATION:

  • One-off donationsDonations in which a single amount is contributed at a specific time.

 Pro-poor donations can be made in the following ways.

  • Bank card (virtual POS on-line payment system):

Donations using a bank card (virtual POS) are made by connecting to the secure website of the payment system provided by Banco Santander. Once the connection has been made, the details of the credit or debit card used to make the donation will be requested: card number and expiry date. The virtual POS page uses the SSL (Secure Sockets Layer) security protocol to guarantee the integrity and confidentiality of the information provided.

  • PayPal:

Donations through the PayPal payment platform are made by connecting to its platform. Once logged in, you will be asked for the necessary data to make the payment in accordance with the terms and conditions of use of the PayPal service.

  • Bank transfer:

If you choose to make donations by bank transfer, these should be made to the bank account listed in the DONATE section of the RECOVER FOUNDATION's website.

Amount of donations.

In general, the DONOR is free to choose the amount and periodicity in the event that the DONOR becomes a member. Notwithstanding the above, the RECOVER FOUNDATION's website, as a suggestion, may include proposals, both in terms of amounts and frequency of collection.

All amounts are inclusive of applicable indirect taxes, unless otherwise stated.

The RECOVER FOUNDATION does not charge any fees for donations. However, the making of donations may result in the collection of fees or other charges by financial institutions for which the RECOVER FOUNDATION is not responsible.

In the event that the amount of the donations made exceeds ONE HUNDRED (100) Euros, in accordance with current legislation on money laundering, the DONOR must identify himself/herself by providing the documents requested to accredit his/her identity.

Tax deductions applicable to donations.

Donations made to the RECOVER FOUNDATION are tax deductible.

Through this link the deductions to which you are entitled for making donations are available.

Delivery of products, services and their guarantees.

As this is an unconditional donation destined for the general purposes of the RECOVER FOUNDATION, the making of the donation does not entail the delivery of any product or service, nor is there any right of withdrawal, as established by Law 7/1996, on the Regulation of Retail Trade and Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of 16 November.

Acquisition of membershipPeriodic contributions of an amount (monthly, quarterly or annual) by direct debit to the donor's bank account.

6 - Security measures

The personal data communicated by the user to Función Recover may be stored in automated or non-automated databases, whose ownership corresponds exclusively to the responsible party, which assumes all technical, organisational and security measures that guarantee the confidentiality, integrity and quality of the information contained therein in accordance with the provisions of current data protection legislation.

The communication between users and www.fundacionrecover.org uses a secure channel, and the data transmitted is encrypted thanks to the https protocol, therefore, I have the best security conditions so that the confidentiality of the users is guaranteed.

7 - Intellectual and Industrial Property.

The user undertakes to respect the Intellectual and Industrial Property rights owned by Función Recover.

The design, images, signs, distinctive signs, trade name, trademarks, logos, products and services contained in this Web Page are protected by Industrial Property Law.

FUNDACIÓN RECOVER is the owner or licensee of all rights to the content of this website and legitimately holds exclusive rights to exploit the same, except those of companies with which the corresponding contract has been signed for the provision of content and are protected by national and international intellectual and industrial property regulations, and these conditions shall also apply to them.

10 - Applicable Law and Competent Jurisdiction.

The terms and conditions governing the Website and all relationships that may arise from it are safeguarded by Spanish law.
