ONLINE SHOP TERMS AND CONDITIONS OF SALE

These general terms and conditions of contract (the “Terms and conditions”) regulate the purchase of products through the online store of Fundación Recover Hospitales para África. Before placing an order, the user must read and expressly accept them. The applicable Conditions will be those in force at the time each order is finalised.

1. Identification of the owner and contact details

The online shop is owned by FUNDACIÓN RECOVER HOSPITALES PARA ÁFRICA (hereinafter, “Recover Foundation”or “Foundation”), a non-profit organisation whose identifying details are:

The institutional purpose of Fundación Recover is to strengthen the capacities of the health centres with which we collaborate, as well as their staff, so that they can sustainably offer a dignified, quality healthcare service to low-income people in Africa. The sale of charity products through the shop helps to support the Foundation's mission, without prejudice to the legal nature of each purchase transaction.

2. Object, scope and acceptance

These Conditions govern the contractual relationship between Fundación Recover and the person who acquires products in the online store (the “Customer”). These apply to distance purchases made via https://fundacionrecover.org/tienda-solidaria/ .

Placing an order implies the express acceptance of these Conditions and, where applicable, of the Privacy Policy, which the Customer must have read and accepted before completing the purchase. The Cookie Policy and the Legal Notice will be provided on the website. If the Customer does not agree with them, they must not complete the purchase.

The Terms are offered in Spanish.

3. Capacity to contract and Customer details

To make a purchase, the Customer must be at least 18 years of age and have sufficient legal capacity to enter into a contract. When acting on behalf of an entity or a third party, the person declares that they have sufficient authorisation to do so.

The Customer undertakes to provide truthful, complete and up-to-date data, especially those necessary for invoicing, payment, collection and delivery of the order. The purchase may be made as a guest and, during the purchase process, the provision of the telephone number will be optional. Likewise, the customer may request the invoice during the checkout process, through the «Additional order information» section. In this case, it will be necessary to provide the corresponding name or company name and tax ID number.

 Recover Foundation shall not be liable for delays or issues attributable to incorrect or incomplete data provided by the Client, without prejudice to any rights to which it is legally entitled.

4. Products and charitable nature of the shop

The shop may offer physical products identified by their product sheet, description, images, price and, where applicable, variants, sizes, materials or other relevant features. Fundación Recover endeavours to ensure that the information is accurate and up to date. The images are for illustrative purposes and there may be minor differences in colour or appearance arising from the screen or the handcrafted nature of certain products, provided that these do not affect their essential characteristics or conformity.

The term “solidarity-based”, the social destination of the profits, or the indication that a purchase supports the purposes of the Foundation do not in themselves convert the price paid for a product into a donation. Unless expressly stated otherwise in the product description or checkout process itself, the acquisition of a physical product constitutes a sale and purchase and does not generate a tax donation certificate for the amount paid.

If the shop includes contributions or “charitable gifts” that do not involve the delivery of an equivalent consumer good, they shall be clearly identified as such prior to purchase, indicating their destination, operation and legal regime.

5. Prices, taxes and additional charges

The applicable prices shall be those shown in the store at the time the order is placed. Unless expressly stated otherwise, prices shall be shown in euros and shall include any taxes that are legally applicable.

Before confirming the purchase, the Customer will see the total amount to be payable, including any applicable shipping costs. Currently, shipping costs amount to €5.45 for deliveries within the Iberian Peninsula, €11.95 for deliveries to the Balearic Islands, Ceuta and Melilla, and €19.95 for deliveries to the Canary Islands. However, shipping will be free for orders of €100 or more within the peninsula.

No additional amounts that have not been previously notified and accepted by the Customer shall be charged.

Fundación Recover may modify prices, promotions and shipping costs for future orders. The changes will not affect orders that have already been confirmed. In the event of promotions or price reductions, current legal rules on price information and previous price will apply when required.

6. Purchasing process and contract formalisation

The purchasing process will be carried out by electronic means. As a general rule, it will include the following steps:

  1. Selection of the product and, where applicable, its variants or quantities.
  2. Adding to basket and reviewing contents.
  3. Introduction or confirmation of the details required to process the guest purchase, including contact details, billing details where applicable, and delivery or collection; the telephone number will be optional.
  4. Selection of the available delivery method: shipping or collection, with country/region Spain and province Madrid where applicable in the checkout form.
  5.  
  6. Selection of the payment method. The user may select PayPal or bank card as the payment method, via Servired/RedSys.
  7. Display of the order summary, total price and acceptance of these Terms and Conditions and the Privacy Policy.
  8. Order confirmation via a button or equivalent action that makes it clear that the order entails an obligation to pay.
  9. Receipt of an order confirmation by email or other durable medium.

Before confirming the order, the Customer will be able to identify and correct errors in the entered data using the tools available in the cart and in the checkout form.

Fundación Recover will archive the necessary order information for the legally required periods and in accordance with its Privacy Policy. The Customer will receive confirmation of their order on a durable medium and may request information regarding it through the customer service channels indicated in these Conditions.

The contract shall be deemed to have been entered into when Fundación Recover confirms the order electronically. Nevertheless, if the unavailability of the product, a manifest error in the price or description, or any other circumstance that legally prevents the order from being fulfilled is subsequently detected, Fundación Recover shall inform the Customer as soon as possible and, where applicable, shall proceed to refund the amounts paid in full and without undue delay.

7. Payment methods and security

The Customer may use the payment methods enabled at any given time in the store, which are currently PayPal or bank card, via Servired/RedSys.

When payment is processed through an external gateway or provider, the transaction will also be subject to the terms and security measures of that provider. Fundación Recover will not have access to full card details when the payment is processed directly by the payment service provider.

If the payment is not authorised, proves to be incomplete or is rejected by the relevant institution, the order may not be finalised or may be suspended until payment is properly received.

8. Availability and substitutions

All orders are subject to availability. If, after an order has been placed, it is discovered that a product is unavailable, Fundación Recover shall inform the Customer as soon as possible and shall offer, as appropriate, the cancellation and refund of the affected product or an alternative of equivalent features and value, always subject to the prior acceptance of the Customer.

No unilateral substitutions will be made that alter the essential characteristics of the purchased product.

9. Shipping, delivery and transfer of risk

Scope of delivery: Mainland / Balearic Islands / Canary Islands / Ceuta / Melilla.

Shipping costs: the applicable shipping cost is €5.45 for orders under €100. For orders of €100 or more, shipping will be free of charge provided it is within the mainland. For shipments to the Balearic Islands, Ceuta and Melilla, the cost will be €11.95 and for shipments to the Canary Islands, the cost will be €19.95. The applicable cost will be shown to the Customer before finalising the order.

The estimated delivery time will be that indicated during the purchase process. Unless otherwise agreed by the parties, Fundación Recover shall deliver the products without undue delay and, in any event, within the maximum legally established period from the conclusion of the contract. If it is not possible to meet this deadline, Fundación Recover will contact the Customer to offer a new date or a refund in accordance with regulations.

The risk of loss of or damage to the products shall pass to the Customer when the Customer, or a third party indicated by the Customer other than the carrier, acquires physical possession of the goods, except in the legally provided scenarios where the carrier has been contracted directly by the Customer outside of the options offered by Fundación Recover.

The Customer shall provide an address where delivery can be made and inspect, to a reasonable extent, the external condition of the package upon receipt. If any visible damage is observed, it is advisable to note it with the carrier and notify Fundación Recover as soon as possible, without this recommendation limiting the consumer's statutory rights.

10. Right of cancellation

When the Customer has the legal status of a consumer or user, they may cancel the purchase of physical products within 14 calendar days following the day on which they, or a third party indicated by them other than the carrier, acquire physical possession of the goods. For orders involving multiple goods delivered separately, the period shall run from the receipt of the last good.

To exercise the right of withdrawal, the Customer must notify their decision by means of an unequivocal statement addressed to:

The Customer may use the model form included at the end of these Terms, although its use is not mandatory. To meet the deadline, it is sufficient for the communication to be sent before the withdrawal period expires.

10.1. Return of goods

After communicating the withdrawal, the Customer must return the goods without undue delay and, in any event, within 14 calendar days of such communication, unless Fundación Recover offers to collect them.

The Customer shall only be liable for any diminished value of the goods resulting from the handling other than what is necessary to establish their nature, characteristics and functioning. The absence or deterioration of the original packaging shall not in itself prevent the exercise of the right of withdrawal, although the potential diminution in value may be assessed where legally applicable.

The Customer shall bear the direct cost of returning the products when exercising their right of withdrawal. This shall not apply when the return stems from a lack of conformity, an order error or a cause attributable to Fundación Recover, in which case the Foundation shall bear the costs legally corresponding to it. 10.2. Refund

In the event of a valid withdrawal, Fundación Recover shall reimburse the payments received corresponding to the returned products and, where legally applicable, the standard delivery costs. If the Customer voluntarily chose a more expensive delivery method than the standard one offered, there shall be no obligation to reimburse the additional cost of such method.

The refund will be made without undue delay and, in any event, within 14 calendar days from the date on which Fundación Recover is informed of the decision to withdraw. Fundación Recover may withhold the refund until the goods have been received or until the Customer provides sufficient proof of their return, whichever condition is met first, unless the Foundation has offered to collect them.

The refund will be made using the same payment method used for the purchase, unless expressly agreed otherwise and provided this does not generate costs for the Customer.

11. Exceptions to the right of cancellation

The right of withdrawal shall not apply in the cases legally excepted. Among others, and where relevant to the products in the store, these may include:

  • Goods made to the Customer's specifications or clearly personalised.
  • Goods that may deteriorate or expire rapidly.
  • Sealed goods which are unsuited for return due to health protection or hygiene reasons and were unsealed after delivery.
  • Other assumptions provided for by consumer regulations that are applicable to the specific nature of the product or service.

When any exception to the right of withdrawal applies, the Customer will be clearly informed of this prior to contracting and, where applicable, in the corresponding returns policy.

12. Product conformity and legal guarantee

Fundación Recover shall be liable to the consumer for any lack of conformity that exists at the time of delivery and becomes apparent within the applicable legal period. For new consumer goods purchased in Spain, the general liability period is currently 3 years from delivery, without prejudice to any specific rules that may apply to certain goods.

When a product does not conform to the contract, the Customer may exercise the legally provided rights, which may include bringing the product into conformity by means of repair or replacement and, where applicable, a price reduction or termination of the contract, in accordance with the requirements and limits established by the regulations.

To manage a warranty claim, the Customer must contact pedidos@fundacionrecover.org stating the order number, affected product and a description of the issue. Photographs or other reasonable information enabling the problem to be assessed may be requested without requiring disproportionate procedures.

13. Damaged, incorrect or incomplete orders

If the order arrives damaged, contains a product other than the one purchased or has obvious defects, the Customer must notify Fundación Recover as soon as reasonably possible. The absence of immediate notification shall not entail the loss of the consumer's corresponding legal rights.

Fundación Recover will provide a suitable solution in compliance with regulations, which may consist, depending on the case, of replacement, substitution, repair, price reduction or refund.

14. Cancellation of orders prior to dispatch

If the Customer wishes to cancel an order before it has been dispatched, they must contact as soon as possible pedidos@fundacionrecover.org. Fundación Recover will attempt to process the request provided the order has not yet entered a logistical phase that prevents its cancellation. If it has already been dispatched, the Customer may exercise the right of withdrawal, where applicable, under the terms set out above.

Fundación Recover shall endeavour to address and resolve any complaints received as quickly as possible and, in any event, within the legally applicable timeframes. If the Client is acting as a consumer, they may also resort to the public information, mediation, arbitration or alternative dispute resolution mechanisms that are legally available and competent for their case.

16. Protección de datos personales

Los datos personales facilitados durante el proceso de compra serán tratados por Fundación Recover para gestionar el pedido, el pago, la facturación cuando se solicite, el envío o la recogida, las devoluciones, las garantías, las incidencias y la atención al Cliente, así como para cumplir obligaciones legales y, cuando exista una base jurídica válida, otras finalidades informadas al interesado. Estos datos pueden incluir, según cada caso, dirección de correo electrónico, condición de compra como invitado, modalidad de entrega seleccionada, país o región de entrega (actualmente España), nombre y apellidos, empresa si se facilita voluntariamente, dirección postal y datos complementarios de entrega, código postal, ciudad, provincia seleccionada , teléfono si se facilita voluntariamente, productos adquiridos, número de pedido, datos fiscales o de facturación cuando se solicite factura, referencias o justificantes de pago, comunicaciones mantenidas con atención al Cliente e información técnica asociada al uso de la tienda online.Las bases jurídicas principales del tratamiento serán, según corresponda, la ejecución del contrato de compraventa y la aplicación de medidas precontractuales solicitadas por el Cliente, el cumplimiento de obligaciones legales en materia fiscal, contable, de consumidores, comercio electrónico, garantías y reclamaciones, el interés legítimo de Fundación Recover en prevenir abusos, fraudes o incidencias de seguridad y gestionar la relación con el Cliente, y el consentimiento cuando sea necesario para el uso de cookies y tecnologías no estrictamente necesarias.

Para la correcta gestión de la tienda, Fundación Recover podrá comunicar datos o permitir el acceso a ellos, cuando sea necesario, a proveedores de servicios de pago o pasarelas de pago, entidades financieras, operadores de transporte o recogida, proveedores tecnológicos de la tienda online, facturación o atención al cliente, asesoramiento profesional, así como a administraciones públicas, autoridades, juzgados y tribunales cuando exista obligación legal. Estos terceros tratarán los datos únicamente en la medida necesaria para prestar sus servicios o cumplir la finalidad correspondiente.

Las comunicaciones transaccionales vinculadas a la compra, tales como confirmaciones de pedido, justificantes, avisos de pago, información sobre envío o recogida, comunicaciones sobre solicitudes de factura, devoluciones, garantías, incidencias o atención al Cliente, serán necesarias para ejecutar la relación contractual o atender las solicitudes del Cliente.

La tienda online puede utilizar cookies u otras tecnologías similares estrictamente necesarias para recordar productos incorporados al carrito, mantener la sesión, habilitar el checkout, procesar el pago, reforzar la seguridad, evitar errores o fraudes y asegurar el funcionamiento de la tienda. Asimismo, podrán utilizarse cookies de Google Analytics, incluida medición mejorada de ecommerce, para fines de análisis y medición, siempre que proceda conforme a la configuración y consentimiento del usuario. La tienda online no utiliza píxeles publicitarios ni etiquetas de Meta, Google Ads, LinkedIn u otras plataformas publicitarias, sin perjuicio de lo previsto en la Política de Cookies publicada en el sitio web.

La información detallada sobre el responsable del tratamiento, finalidades, bases jurídicas, destinatarios, transferencias internacionales, plazos de conservación, ejercicio de derechos y uso de cookies se encuentra en la Privacy Policy y, en su caso, en la Cookie Policy publicadas en el sitio web de Fundación Recover, que complementan estas Condiciones.

17. Comunicaciones electrónicas y prueba de la contratación

Las comunicaciones relativas al pedido podrán realizarse por correo electrónico a la dirección facilitada por el Cliente. El Cliente acepta recibir por esta vía confirmaciones de compra, facturas cuando proceda, información sobre envío o recogida, devoluciones, garantías, incidencias y otras comunicaciones necesarias para ejecutar el contrato.

Los registros electrónicos del proceso de compra, junto con la confirmación del pedido y los justificantes de pago, podrán utilizarse como prueba de la contratación en los términos admitidos por la legislación aplicable.

18. Propiedad intelectual e industrial

Todos los contenidos de la tienda online y del sitio web de Fundación Recover, incluyendo, a título enunciativo, textos, fotografías, imágenes, diseños, logotipos, nombres comerciales, signos distintivos, estructura, selección, ordenación y forma de presentación de los contenidos, son titularidad de Fundación Recover o de terceros que han autorizado su uso, y se encuentran protegidos por la normativa aplicable en materia de propiedad intelectual e industrial.

La compra de productos en la tienda online no implica la cesión, licencia o autorización de uso de derechos de propiedad intelectual o industrial de Fundación Recover o de terceros, salvo en lo estrictamente necesario para el uso ordinario y personal de los productos adquiridos conforme a su naturaleza.

Queda prohibida la reproducción, distribución, comunicación pública, transformación, puesta a disposición, extracción, reutilización o cualquier otra forma de explotación de los contenidos, diseños, imágenes, marcas, logotipos o signos distintivos de la tienda online sin autorización previa y por escrito de Fundación Recover o del titular de los derechos que corresponda, salvo en los casos legalmente permitidos.

El Cliente no podrá utilizar el nombre, imagen, logotipos, marcas o signos distintivos de Fundación Recover con fines comerciales, promocionales o de forma que pueda generar confusión, asociación indebida o menoscabo de la imagen o reputación de la Fundación, salvo autorización expresa y por escrito.

19. Circunstancias fuera del control razonable

Fundación Recover no responderá por retrasos o incumplimientos debidos a acontecimientos imprevisibles o inevitables fuera de su control razonable, siempre que actúe con la diligencia exigible y cumpla las obligaciones legales de información, reembolso o solución que correspondan. Esta cláusula no limita los derechos imperativos de consumidores y usuarios.

20. Modificación de las Condiciones

Fundación Recover podrá actualizar estas Condiciones para adaptarlas a cambios legales, técnicos, operativos o de la propia tienda. Las nuevas versiones se publicarán con su fecha de actualización y se aplicarán a los pedidos formalizados después de su entrada en vigor. Los pedidos ya celebrados seguirán sujetos a las condiciones aceptadas en el momento de la compra, salvo que una norma imperativa disponga otra cosa.

21. Nulidad parcial y no renuncia

Si alguna cláusula fuera declarada total o parcialmente nula, inválida o inaplicable, dicha circunstancia no afectará a la validez del resto de las Condiciones. La falta de ejercicio de un derecho por Fundación Recover no se interpretará como renuncia a dicho derecho.

22. Legislación aplicable y jurisdicción

Estas Condiciones se rigen por la legislación española. Cuando el Cliente tenga la condición de consumidor o usuario, cualquier controversia se resolverá ante los juzgados y tribunales que resulten competentes conforme a las normas imperativas de protección de consumidores, sin que esta cláusula suponga una renuncia a los fueros que legalmente le correspondan.

En relaciones con Clientes que no tengan la condición de consumidores o usuarios, las partes podrán someterse, si legalmente procede, a los juzgados y tribunales de Madrid, salvo que se acuerde otra cosa por escrito.

ANEXO I · Modelo de formulario de desistimiento

Este formulario solo debe cumplimentarse y enviarse si desea desistir del contrato.

Información básica sobre protección de datos

Los datos personales facilitados en este formulario serán tratados por Recover Foundation como responsable del tratamiento.

La finalidad del tratamiento es gestionar la solicitud de desistimiento, identificar el pedido afectado, tramitar la devolución del producto, realizar el reembolso que corresponda, atender posibles incidencias o reclamaciones y cumplir las obligaciones legales aplicables en materia de consumidores y usuarios.

La base jurídica del tratamiento es la ejecución del contrato de compraventathe cumplimiento de obligaciones legales y, en su caso, el interés legítimo de Fundación Recover para acreditar la gestión de la solicitud y defender sus derechos ante posibles reclamaciones. Los datos se conservarán durante el tiempo necesario para gestionar el desistimiento y, posteriormente, durante los plazos legalmente exigibles o necesarios para atender posibles responsabilidades.
